Who Is the Child Visa Subclass 101 Generally For?
The Child Visa (Subclass 101) is decided while the child is outside Australia, so the file has to stand on paper alone. There is no opportunity for a case officer to observe day-to-day family life, which means the documentary chain proving the parent–child link — and proving who currently has lawful care of the child — carries almost all of the weight. Eligible children include biological children of the sponsoring Australian citizen or permanent resident, adopted children where the adoption is legally recognised both in the country where it took place and in Australia, and step-children of a current or former partner of the sponsor.
Offshore processing brings its own mechanics. The application is handled by an overseas processing area, health examinations are usually completed with a panel physician in the child's country, and once granted the visa carries an initial entry deadline by which the child must first travel to Australia. Age requirements: generally under 18 at time of application, with limited provision for financially dependent full-time students aged 18–25, and for adults unable to work because of a disability.
