When is a death certificate translation required?
A NAATI-certified English translation of a death certificate is required in a range of Australian visa and legal contexts, including:
- Family visa applications where a parent is deceased and the parent-child relationship must be established through that deceased parent.
- Partner visa applications where the sponsor or applicant was previously married and the prior spouse is deceased — to demonstrate the previous marriage has legally ended.
- Parent visa applications (subclass 103 and 143) where the balance of family test relies on a deceased sibling.
- Citizenship applications in some circumstances.
- Probate and estate matters in Australia.
- Child visa applications (subclass 101 and 802) where custody or guardianship arrangements arise from a parent's death.
Death certificates from another language-speaking countries
The death certificate is known as the Acta de Defunción or Certificado de Defunción in most many countries. The issuing authority varies by country:
- Colombia — issued by the Notaría or Registraduría Nacional.
- Chile — issued by the Registro Civil e Identificación.
- Argentina — issued by the Registro Civil.
- Peru — issued by RENIEC.
- Mexico — issued by the Registro Civil.
- Venezuela — issued by the Registro Civil.
- Ecuador — issued by the Registro Civil.
Regardless of the issuing authority, the document is in Spanish and must be translated into English by a NAATI-certified translator before submission to Australian authorities.
What does the translation include?
A NAATI-certified death certificate translation includes the full translation of all text on the document, including the deceased's name, date and place of death, cause of death (if stated), issuing authority details, official seals descriptions, registration numbers, and any marginal notes. Every page of the original document is translated — including the reverse side if it contains text or stamps. The translation is accompanied by a certification statement from the NAATI-accredited translator confirming the translation is complete and accurate.
Submitting the translation
The translated death certificate should be submitted alongside the original document. For Department of Home Affairs visa applications, both documents are uploaded together in ImmiAccount. For Australian court matters such as probate, the translation is provided with the original to the court or the legal representative handling the matter. The translation does not need to be physically attached to the original — it is a separate, certified document.
